Please read these Terms carefully before accessing or using the Website. If you do not agree to the Terms, you may not access the Platform.

We reserve the right to update and change the Terms and Conditions by posting updates and changes to the Platform. You are advised to check the Terms and Conditions from time to time for any updates or changes that may impact you. If at any point such amendments are not acceptable to you, we advise you to cease using the Platform at such time.

Eligibility

You hereby represent and warrant that you have the right, power, and authority to agree to the Terms, to become a party to a legally binding agreement and to perform your obligations hereunder. You must be at least 18 years of age to use this Platform. By using the Platform, you represent and warrant that you are at least 18 years old.

Platform Disclaimer

VahanBazaar.in is an online marketplace platform that connects vehicle buyers and sellers. Users agree and acknowledge that VahanBazaar is only an intermediary platform that facilitates connections between buyers and sellers. VahanBazaar does not own, sell, resell, inspect, or guarantee any vehicles listed on the Platform.

The Users further understand and accept that:

• Users are ultimately responsible for choosing and interacting with other Users on the Platform. VahanBazaar is only a facilitator and shall not be held responsible or liable for the selection or interaction of Users with other Users.
• VahanBazaar does not recommend or endorse any seller, buyer, or vehicle listed on the Platform. We do not make any representations or warranties with respect to other Users or the vehicles listed by them.
• VahanBazaar shall not be liable for any disputes between Users. There is no liability on VahanBazaar for any consequences that Users may face while dealing with other Users on the Platform.
• Information regarding vehicles and Users displayed on the Platform is mainly self-reported by the Users and may change or become inaccurate. Users are encouraged to independently verify any such information.
• VahanBazaar cannot assure that all transactions will be completed, nor does it guarantee the ability or intent of Users to fulfil their obligations under any transaction. Users are advised to perform their own due diligence prior to engaging with other Users.
• If a seller does not respond to calls or messages after a buyer has revealed the seller's contact number, VahanBazaar is not responsible, as the service (providing a verified phone number) has been fully delivered.

Intermediary Status

VahanBazaar operates as an intermediary as defined under Section 2(1)(w) of the Information Technology Act, 2000, and claims protection under Section 79 of the said Act and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 ("Intermediary Guidelines"). In accordance with these provisions:

• VahanBazaar does not initiate, select, or modify the information transmitted or stored by Users on the Platform. Any content, listings, or information posted by Users is the sole responsibility of the User who has posted it.
• VahanBazaar observes due diligence and complies with the Intermediary Guidelines, including providing Users with terms of use that prohibit unlawful content, a mechanism for reporting and taking down objectionable content, and cooperation with government agencies as required by law.
• Users may report any listing or content that they believe is unlawful, fraudulent, misleading, or violates the rights of any person by contacting us at support@vahanbazaar.in or using the Contact Us form. VahanBazaar shall act upon such complaints within 36 hours of receipt and remove or disable access to the reported content within 72 hours where required.
• VahanBazaar shall not be liable for any third-party information, data, or content hosted on the Platform, provided it complies with the due diligence obligations under the Intermediary Guidelines.

User Accounts & Verification

To access certain features of the Platform, Users must create an account by verifying their mobile phone number via WhatsApp OTP (One-Time Password). By creating an account, you agree that:

• You will provide accurate and current information, including a valid mobile phone number that belongs to you.
• A mobile number can only be used to create one account. Creating multiple accounts is prohibited, and VahanBazaar reserves the right to deactivate duplicate accounts.
• You are responsible for all activities that occur under your account.
• You must not share your account credentials or allow others to access your account.
• VahanBazaar reserves the right to suspend or terminate your account at any time, without notice, for conduct that we determine violates these Terms or is harmful to other Users, us, or third parties.

Vehicle Listings

Sellers who list vehicles on the Platform represent and warrant that:

• They are the rightful owner of the vehicle or are authorized to sell it.
• All information provided about the vehicle (make, model, year, price, condition, etc.) is accurate and complete to the best of their knowledge.
• The vehicle's Registration Certificate (RC) and registration number are genuine and belong to the listed vehicle.
• They will not list stolen vehicles, vehicles under dispute, vehicles with undisclosed encumbrances, or vehicles that cannot legally be sold.
• VahanBazaar reserves the right to remove any listing at any time, without notice, if it is found to violate these Terms or Applicable Law.

Sellers may list a maximum of 5 active vehicles at any given time. Once a vehicle is sold, the seller should mark it as sold on the Platform, which will free up a listing slot.

Paid Services & Credits

VahanBazaar offers the following paid services:

• Manual Verification Fee (₹99): If a seller's vehicle does not pass automatic AI verification, they may opt for manual review by our team for a one-time fee of ₹99. This fee is non-refundable as the service is consumed immediately upon submission.
• Buyer Contact Plans: Buyers may purchase credit plans to reveal seller phone numbers. Each plan provides a fixed number of contact reveal credits. Plans and pricing are displayed on the Platform before purchase.
• Vahan Verify Report (₹49): A one-time paid report delivering full RC data from the government VAHAN database and the list of pending traffic challans for the specified vehicle. Report is generated, shown on-screen, and deleted when the User leaves the results page. The User is solely responsible for downloading the PDF copy before leaving the page.
• AI Vahan Inspection Report (₹249): A one-time paid report that additionally includes AI analysis of six user-uploaded photos, model-specific known-issue research, a set of inspection questions to ask the seller, and a rough price range estimate. Same ephemeral-report behaviour — download before leaving.

New users receive 5 free contact reveal credits upon their first login. Free credits have no monetary value and are not refundable.

Before purchasing a plan or using a credit, Users are shown a clear confirmation screen with the amount, terms, and what they will receive. By proceeding, the User acknowledges and accepts these terms.

Vahan Check Tools — Specific Terms

The following additional terms apply to Vahan Verify and AI Vahan Inspection (collectively, "Vahan Check Tools"):

• Informational Purpose Only. Reports generated by Vahan Check Tools are informational summaries based on government VAHAN data, third-party traffic records, publicly available model reliability information, and (for AI Vahan Inspection) AI-generated observations on user-uploaded photos. They are not a guarantee of vehicle condition, title, ownership clarity, mechanical fitness, or fitness for purpose. They are not a substitute for a physical mechanical inspection by a qualified technician, and they do not constitute professional legal, automotive, or financial advice.
• No Verdict or Recommendation. Vahan Check Tools do not tell you whether to buy a vehicle. They present facts and observations. The purchase decision is solely yours.
• Ephemeral Reports. Reports are generated on demand and displayed in your browser once. When you navigate away from or close the results page, the report is permanently deleted from our servers. We cannot recover a report for you later. You are solely responsible for downloading the PDF copy if you wish to retain it. Loss of the PDF is not a basis for refund or re-generation.
• Data Accuracy. The accuracy of Vahan Check reports depends on the accuracy of underlying third-party data sources (VAHAN registry, RTO challan records, publicly available information). We do not warrant that the data is complete, current, or error-free. In particular, challan records can lag real-time traffic enforcement by days or weeks.
• AI Photo Analysis. For AI Vahan Inspection, photo analysis is performed by AI models that describe visible features in the photos you upload. The AI cannot detect issues that are not visible in the photos, can misinterpret lighting/angles/camera artifacts, and is not a substitute for hands-on mechanical inspection. If the seller has misrepresented the vehicle in the photos you upload, the report cannot detect it.
• Photo Authorization. By uploading photos for AI Vahan Inspection, you represent that you have the right to upload those photos and to have them analysed by our service providers (including Google Gemini). You further authorize us to transmit them to third-party AI services for analysis. Photos are deleted from our systems after analysis.
• Refund — Vahan Verify & AI Vahan Inspection. These reports are digital services consumed upon generation. We do not offer refunds once a report has been successfully generated and displayed. However, if the report generation fails due to a technical error on our end (for example, VAHAN API unavailability) and no report was rendered to you, we will initiate an automatic refund of the fee within 5 business days. Refunds go to the original Payment Instrument.
• No Liability for Vehicle Decisions. VahanBazaar shall not be liable for any loss, damage, or injury arising out of or in connection with any vehicle purchase or non-purchase decision made based on a Vahan Check report, regardless of whether the report content was accurate, incomplete, or inaccurate.
• Pre-Generation Consent Required. Before any Vahan Check report is generated or payment is accepted, the User must explicitly tick a checkbox confirming they have read and agree to these Terms & Conditions, the Refund Policy, and the Privacy Policy, and acknowledge that the report is informational only and is not a substitute for a physical mechanical inspection. A record of this consent (timestamp and policy version) is retained against the User's account for audit purposes.
• Limitation of Liability — Capped at Fee Paid. To the maximum extent permitted by the Consumer Protection Act, 2019 and the Information Technology Act, 2000, the total aggregate liability of VahanBazaar arising out of or related to any Vahan Check report — whether in contract, tort, statute, or otherwise — is limited to the fee actually paid by the User for that specific report (i.e., ₹49 for Vahan Verify or ₹249 for AI Vahan Inspection). VahanBazaar shall not be liable for any indirect, consequential, incidental, punitive, exemplary, or special damages; loss of profit or business; diminution of vehicle value; repair costs; accident damages; or any third-party claims, even if advised of the possibility of such damages.
• User Indemnity. The User agrees to indemnify, defend, and hold harmless VahanBazaar, its founders, employees, contractors, and affiliates from and against any claim, demand, loss, damage, cost, or expense (including reasonable legal fees) arising out of or related to: (a) the User's reliance on any Vahan Check report; (b) the User's purchase or non-purchase decision made on the basis of such a report; or (c) the User's interactions with the seller of the subject vehicle.
• No Broker, Agent, or Facilitator Relationship with Seller. VahanBazaar is not a party to, broker of, agent for, custodian of, or facilitator of any vehicle sale between a buyer and a seller. VahanBazaar has no ownership, custody, possession, or inspection rights over any subject vehicle. VahanBazaar does not verify the identity of the seller, the authenticity of the RC, or the truthfulness of the seller's representations. Any fraud, misrepresentation, or non-disclosure by the seller is outside VahanBazaar's control and is a matter between buyer and seller (and, where applicable, law-enforcement authorities).
• Error-Reporting Window. If the User believes any factual data in a generated report is incorrect, the User must contact support@vahanbazaar.in within seven (7) days of report generation, providing the report receipt ID. After this window, reports are deemed accepted as rendered.

Payments & Chargebacks

All payments on the Platform are processed through authorized third-party payment gateways. VahanBazaar is a separate entity from the payment gateway provider and does not store your payment card or banking details. The payment gateway may change from time to time, and the current gateway will always be identified during the checkout process.

• By making a payment, you authorize the payment gateway to charge the specified amount from your chosen Payment Instrument.
• VahanBazaar shall not be liable for any issues arising from the payment gateway's processing, including but not limited to transaction failures, delays, or errors caused by the payment gateway or your bank.
• In the event of a failed payment where the amount has been debited, a refund will be processed within 5–7 business days to the original Payment Instrument.

Chargebacks: If a User initiates a chargeback or payment dispute with their bank or payment provider for a Transaction where the service was duly delivered (e.g., seller contact number was revealed), VahanBazaar reserves the right to suspend the User's account, recover the disputed amount, and pursue any associated fees or penalties. Users agree to cooperate with VahanBazaar in investigating any chargeback claims and to provide necessary documentation within 5 business days of request.

Definitions

VahanBazaar's Rights

You agree that we may collect, store, and share the information provided by you in order to deliver the products and/or services availed by you on our Platform and/or contact you in relation to the same. Our use of your information is governed by our Privacy Policy.

Your Responsibilities

You agree to provide us with true, complete and up-to-date information about yourself as may be required for the purpose of completing the Transactions. This information includes but is not limited to the personal details such as name, email address, phone number, delivery address, age, and gender (or any other information that we may deem necessary for us to fulfil the Transaction) as well as the accurate payment information required for the transaction.

Prohibited Actions

You may not access or use the Platform for any purpose other than that for which we make the Platform available. The Platform may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.

As a User of the Platform, you agree not to:

• Systematically retrieve data or other content from the Platform to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
• Make any unauthorized use of the Platform, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretenses.
• Circumvent, disable, or otherwise interfere with security-related features of the Platform, including features that prevent or restrict the use or copying of any Content or enforce limitations on the use of the Platform and/or the Content contained therein.
• Trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information such as user passwords.
• Make improper use of our support services or submit false reports of abuse or misconduct.
• Engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools.
• Interfere with, disrupt, or create an undue burden on the Platform or the networks or services connected to the Platform.
• Attempt to impersonate another user or person or use the username of another user.
• Use any information obtained from the Platform in order to harass, abuse, or harm another person.
• Use the Platform as part of any effort to compete with us or otherwise use the Platform and/or the Content for any revenue-generating endeavor or commercial enterprise.
• Decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Platform.
• Attempt to bypass any measures of the Platform designed to prevent or restrict access to the Platform, or any portion of the Platform.
• Harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing any portion of the Platform to you.
• Copy or adapt the Platform's software, including but not limited to Flash, PHP, HTML, JavaScript, or other code.
• Upload or transmit (or attempt to upload or to transmit) viruses, Trojan horses, or other material, including excessive use of capital letters and spamming (continuous posting of repetitive text), that interferes with any party's uninterrupted use and enjoyment of the Platform.
• Disparage, tarnish, or otherwise harm, in our opinion, us and/or the Platform.
• Use the Platform in a manner inconsistent with any applicable laws or regulations.

Intellectual Property

All intellectual property rights in the Platform, including but not limited to the VahanBazaar name, logo, brand identity, website design, user interface, source code, algorithms, proprietary vehicle verification system, and all related content, graphics, and documentation, are the exclusive property of VahanBazaar / Kora Consultants and are protected under applicable intellectual property laws of India.

• Users are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for its intended purpose — listing, browsing, and purchasing contact information for used vehicles.
• No part of the Platform may be reproduced, distributed, modified, adapted, publicly displayed, or exploited in any form without the prior written consent of VahanBazaar.
• Users retain ownership of the content they submit (vehicle photos, descriptions, etc.) but grant VahanBazaar a non-exclusive, royalty-free, worldwide license to use, display, and distribute such content on the Platform for the purpose of providing our services.
• Any feedback, suggestions, or ideas submitted by Users to VahanBazaar may be used by VahanBazaar without obligation or compensation to the User.

Limitation of Liability

To the maximum extent permitted by Applicable Law:

• VahanBazaar shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Platform or Services.
• VahanBazaar's total liability for any claim arising out of these Terms shall not exceed the total amount paid by you to VahanBazaar in the 3 months preceding the claim. For the avoidance of doubt, free credits provided upon registration have no monetary value, and no claim for deficiency of service may be made in respect of services consumed using free credits.
• VahanBazaar is not responsible for the condition, quality, safety, legality, or any other aspect of vehicles listed by sellers on the Platform. All vehicle transactions are strictly between the buyer and seller.
• VahanBazaar is not responsible if a seller does not respond to calls, has already sold the vehicle, or provides inaccurate vehicle details. Our service is limited to providing verified seller contact information.
• The User's sole recourse in the event of a deficiency in service is to initiate the refund process, which is subject to the terms set out in our Refund & Cancellation Policy.

User Indemnification: The User shall indemnify and hold harmless VahanBazaar, its officers, directors, employees, and agents from and against any and all claims, demands, liabilities, losses, damages, costs, and expenses arising out of or relating to: (a) any breach of these Terms by the User; (b) any fraudulent, negligent, or illegal activity by the User; (c) any vehicle transaction between Users; or (d) any content or information provided by the User on the Platform.

VahanBazaar's Commitment: VahanBazaar will use reasonable efforts to ensure the Platform operates as described, to resolve reported issues in a timely manner, and to process eligible refunds in accordance with our Refund & Cancellation Policy. In the event of a service deficiency attributable to VahanBazaar, we will work in good faith to remedy the issue or provide appropriate compensation within the limits set out in these Terms.

Force Majeure

VahanBazaar shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond VahanBazaar's reasonable control, including but not limited to:

• Natural disasters, epidemics, pandemics, or acts of God
• Wars, terrorism, riots, civil disturbances, or government actions
• Server outages, internet disruptions, or telecommunications failures
• Payment gateway downtime, failures, or service disruptions by third-party providers
• Power failures, hardware/software malfunctions, or cyber attacks
• Changes in applicable laws, regulations, or government orders

In the event of a force majeure event, VahanBazaar's obligations shall be suspended for the duration of such event, and VahanBazaar will use reasonable efforts to resume services as soon as practicable.

Account Deletion & Data Erasure

In accordance with the Digital Personal Data Protection Act, 2023 (DPDPA), Users have the right to request deletion of their account and erasure of their personal data. The process is as follows:

• Users may request account deletion by emailing support@vahanbazaar.in or using the Contact Us form with the subject "Account Deletion Request" and the registered phone number.
• Upon receiving a valid request, VahanBazaar will process the deletion within 30 days.
• Upon deletion: all active vehicle listings will be removed from the Platform; any unused contact credits (free or purchased) will be forfeited and are non-refundable; the User's phone number, name, and email will be erased from our records.
• Certain data may be retained even after account deletion as required by applicable law, including: transaction records (for legal and accounting purposes), contact reveal records (for dispute resolution), and any data subject to an ongoing legal proceeding, investigation, or chargeback dispute.
• Account deletion is irreversible. If the User wishes to use the Platform again, they must create a new account.

Guidelines for Reviews

We may provide you areas on the Platform to leave reviews or ratings. When posting a review, you must comply with the following criteria:

• You should have firsthand experience with the person/entity being reviewed.
• Your reviews should not contain offensive profanity, or abusive, racist, offensive, or hate language.
• Your reviews should not contain discriminatory references based on religion, race, gender, national origin, age, marital status, sexual orientation, or disability.
• Your reviews should not contain references to illegal activity.
• You should not be affiliated with competitors if posting negative reviews.
• You should not make any conclusions as to the legality of conduct.
• You may not post any false or misleading statements.
• You may not organize a campaign encouraging others to post reviews, whether positive or negative.

We may accept, reject, or remove reviews in our sole discretion. We have absolutely no obligation to screen reviews or to delete reviews, even if anyone considers reviews objectionable or inaccurate. Reviews are not endorsed by us, and do not necessarily represent our opinions or the views of any of our affiliates or partners.

By posting a review, you hereby grant to us a perpetual, non-exclusive, worldwide, royalty-free, fully paid, assignable, and sublicensable right and license to reproduce, modify, translate, transmit by any means, display, perform and/or distribute all content relating to reviews.

Governing Laws & Dispute Resolution

These Terms, their subject matter and their formation, are governed by the laws of India. You and we both agree that the courts of Bengaluru, Karnataka, India will have exclusive jurisdiction over any dispute.

Any dispute or claim arising out of or in connection with or relating to these Terms or their breach, termination or invalidity hereof ("Dispute") shall first be attempted to be resolved amicably between the parties. If the Dispute is not resolved within 30 (thirty) days of written notice, it shall be referred to and finally resolved by arbitration in Bengaluru in accordance with the Arbitration and Conciliation Act, 1996 for the time being in force.

Within 30 (thirty) days of the issue of a notice of Dispute, the parties shall mutually agree on the appointment of a sole arbitrator. If such mutual agreement is not arrived at within the aforesaid 30 (thirty) days' period, the parties shall appoint such sole arbitrator in accordance with the Arbitration and Conciliation Act, 1996.

The seat of arbitration shall be Bengaluru, India and the arbitration proceedings shall be conducted in the English language. The parties shall keep the arbitration confidential and not disclose to any person, other than those necessary to the proceedings, any information, transcripts or award unless required to do so by law.

The decision of the arbitrator shall be final and binding on all the parties hereto. The cost of arbitration shall be borne in the manner and by a party as determined by the arbitrator. For disputes involving Transaction Amounts below ₹1,000, VahanBazaar encourages resolution through the grievance redressal mechanism outlined below before initiating formal dispute resolution proceedings.

Consumer Disputes: Nothing in this section shall restrict the right of a consumer to file a complaint before the appropriate Consumer Disputes Redressal Commission (District, State, or National) under the Consumer Protection Act, 2019, at the place of residence or business of the complainant. The exclusive jurisdiction clause above applies to civil suits and commercial disputes, and does not override the statutory rights of consumers under the Consumer Protection Act, 2019.

Disclaimer

• Upon initiating a Transaction, you as a User are entering into a legally binding and enforceable contract with us to purchase the products and/or services, and you shall pay the price as listed on the Platform through legitimate and legal sources of funds and through the accepted Payment Instruments.
• You shall provide accurate payment details to the secure payment system for making purchase on the Platform. The information provided by you may be utilized or shared with any third party if required in relation to fraud verifications or by law, regulation or court order.
• We expressly disclaim all liabilities that may arise as a consequence of any unauthorized use of a User's Payment Instrument.
• All payments undertaken by you are subject to your own risk and volition. We shall not be liable for any loss or damage occurred to you arising directly or indirectly due to the decline of authorization for any Transaction, malfunction, errors and/or unscrupulous activities.
• If you receive a User identification code, order ID, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party.
• The content on our Platform is provided for general information only. The information provided does not amount to advice from us in any manner and should not be relied upon.
• Where our Platform contains links to other websites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them.
• This Platform includes information and materials uploaded by other Users of the Platform. You understand that such information and materials have not been verified or approved by us.
• We do not guarantee that our Platform will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programs and platform to access our Platform. You must use your own virus protection software.

Entire Agreement

These Terms & Conditions, together with our Privacy Policy and Refund & Cancellation Policy, constitute the entire agreement between you and VahanBazaar with respect to your use of the Platform, and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral, written, or electronic, between you and VahanBazaar. No oral or written statement, representation, or promise not contained in these documents shall be binding on either party.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other provision of these Terms, and these Terms shall be construed as if the invalid, illegal, or unenforceable provision had never been included.
